Debt collection notices

This notice from Portfolio Recovery — debt validation

Plain answer

Portfolio Recovery is seeking payment on a debt. Use the notice’s dispute end date to request verification and original-creditor information in writing.

Time-sensitiveThe validation period generally ends 30 days after you receive, or are assumed to receive, the validation information; use the end date printed on the notice.
First move

Circle the dispute end date on the notice and save the envelope or electronic delivery record.

This notice

The notice says, “You have until the date shown below to dispute all or part of this debt.” It is validation information from a debt collector, not a court judgment.

Urgent?

Use the dispute end date printed on the notice. A written dispute sent within the validation period generally requires the collector to pause collection of the disputed amount until it sends verification.

First move

Circle the end date and keep a complete copy of the notice and delivery record.

Official path

  1. Read the creditor name, itemization date, account number, current amount, and dispute end date on the notice.
  2. Compare those details with your own statements and credit reports before discussing payment.
  3. Send a written dispute to the address or electronic method listed on the notice before the end date.
  4. Request the name and address of the original creditor if it differs from the current creditor.
  5. Keep the letter, attachments, delivery proof, and every response from Portfolio Recovery.
  6. Submit a complaint through the CFPB debt collection page if the collector ignores a timely dispute or uses false, unfair, or abusive practices.

What people reported

Often helps

  • People reported that quoting the notice number and dispute end date reduced confusion about which account they meant.
  • People reported that asking for the original creditor and an itemized amount made a response easier to compare with old records.

Often fails

  • People reported expecting a wet-ink contract and assuming the debt vanished when they received only statements; federal verification can be narrower than that marketing claim.

Re: Notice number [NOTICE NUMBER], account ending [ACCOUNT ENDING]

To Portfolio Recovery Associates:

I am responding to your validation notice dated [NOTICE DATE]. I dispute [ALL / THE FOLLOWING PART] of the debt described in that notice. I am sending this request before the dispute end date shown as [DISPUTE END DATE].

Please provide verification of the debt, including the name and address of the original creditor, the name of the current creditor, and an itemization showing how you calculated the current amount. Please also provide information that identifies the account and explains why you believe I am responsible for it.

This letter is a request for information and a dispute. It is not an acknowledgment that I owe the debt. Please record the account as disputed and send your response to the address above.

I am keeping a copy of this letter and proof of delivery.

Sincerely,
[YOUR FULL NAME]

  • You were served with a lawsuit; file or obtain the required court response by the court deadline.
  • A judgment or garnishment already exists; ask a consumer lawyer about the order and local procedure.
  • The debt may be too old to sue on; get state-specific legal advice before making a payment or written admission.

FAQ

Does a validation request erase the debt?
No. A timely written dispute generally pauses collection of the disputed amount until the collector sends verification. Collection may resume after that response.
Must Portfolio Recovery send an original signed contract?
Federal validation rules do not always require a wet-ink contract. A response may be account statements or other information that identifies the debt, creditor, and amount.
What if the 30-day date already passed?
You may still ask for information and dispute what is wrong. Missing the period can change the special pause rights, so do not state that the debt is yours while you are still checking it.
Should I pay before I get a response?
Do not pay only because of pressure on the first call. First confirm the collector, the original creditor, the amount, and whether the debt is yours.
